Excelenţă,
Aproape 20 de ani de luptă inegală pentru adevăr ne-au făcut să ne pierdem încrederea în sistemul judiciar şi în guvernele din România. Modul în care am obţinut dreptul ca cererea noastră (nr. 33810/07) să fie judecată cu prioritate la Curtea Europeană a Drepturilor Omului, precum şi o parte a dialogurilor cu diverşi funcţionari din cadrul Curţii, ne-au ridicat şi ne ridică multe semne de întrebare. Decizia dvs., d-le Preşedinte, din 4.11.2008 ne-a redat speranţa că în sfârşit principiul egalităţii de arme în acest dosar va fi respectat. Aplicarea doar parţială, şi aceasta după multe proteste, timp de 10 luni, a dispoziţiei din 4.11.2008, ca şi a celei intermediare din 9.07.2009, m-a adus în situaţia de a apela la aceasta ultimă soluţie – greva foamei, ajunsă acum în a 66-a zi. Nu am dorit gestul, dar mi-l asum, doar pentru aflarea adevărului prin justiţie în peste 1500 cazuri de crime pe timp de pace. Este în acord cu principiile drepturilor omului pentru care luptăm si colegii mei şi eu – atât personal, cât şi în calitate de preşedinte al Asociaţiei „21 Decembrie 1989”; este şi moral şi absolut îndreptăţit după aproape 20 de ani de aşteptare răbdătoare.
Domnule Preşedinte, aveţi obligaţia profesională de a împărţi dreptatea. Împărţiţi-o şi daţi-ne arme egale cu cele ale guvernului pârât şi vinovat pentru neaplicarea dispoziţiilor din 4.11.2008 şi 9.07.2009. În momentul eliberării către Asociaţie a copiei integrale a dosarului 97/P/1990, aflat, deja copiat în întregime, la Parchetul de pe lângă Înalta Curte de Casaţie şi Justiţie, promit că voi înceta greva foamei imediat. Doar în aceste condiţii avem toţi onoare – eu în faţa victimelor şi a legii, dvs. şi guvernul român faţă de principiile legii.

Your Excellency,
Almost 20 years of uneven fighting for truth have made us lose faith in Romania’s judicial system and its governments. The way we gained the right for our complaint (no. 33810/07) to be judged with preference at the European Court of Human Rights, as well as some of the dialogues with Court clerks have raised many questions for us. Your decision from 4 November 2008, Mr. President, has made us hopeful that the principle of equality of arms in legal proceedings in this file will finally be observed. The way Romanian authorities have only partially put into effect, and solely following numerous protests spread over 10 months, your ruling from 4 November 2008, as well as the intermediate one from 9 July 2009, has led me to resort to this last solution – the hunger strike, which is now in its 66th day. I did not desire this gesture, but I fully stand by it, only in the name of getting, through the judiciary, to the truth in over 1.500 cases of murder in a time of peace. It is consonant with the principles of human rights that both my colleagues and me (personally, but also as President of the Association “21 December 1989”) are standing for; it is also a moral and fully justified gesture after almost 20 years of patiently waiting.
Mr. President, you have the professional obligation to deal out justice. Please, do so and give us equal arms with the defendant Government, guilty of non-compliance with the rulings of 4 November 2008 and 9 July 2009. When the integral copy of case file no. 97/P/1990, which has already been made and is in possession of the Prosecutor’s Office attached to the High Court of Cassation and Justice, is released to the Association “21 December 1989”, I will immediately put an end to the hunger strike. Only under these conditions we could all call ourselves honourable – me in front of the victims and the law, you and the Romanian Government unto legal principles.
